MTA blames 'human error' after loose piece of rail from overnight repairs triggers Harlem train derailment – New York Daily News


A loose piece of rail sent part of a packed subway train jumping from the tracks and careening into a wall in Harlem on Tuesday — forcing hundreds to crawl out into the tunnel to safety and crippling service citywide. 

Thirty-four straphangers were treated for minor injuries — among them a little baby — after two cars of the Brooklyn-bound A train struck a piece of replacement rail that was stored on the tracks outside the 125th St. station about 9:45 a.m., authorities said.

“The train was peeled open like a can opener,” said Paul Navarro, track division chairman for the Transport Workers Union, after visiting the accident site.

Straphangers described a harrowing scene as the train came to a screeching halt, sending sparks flying into the air and smoke pouring into the darkened cars.

After being trapped for several minutes, panicked riders on the A train and a trailing D train broke windows on their subway cars and climbed out onto the tracks.

“I had to jump out,” said Emma Virani, 27, of Brooklyn, who was on the D train.

The derailment marked the latest in a series of subway accidents that have caused chaos underground and prompted calls for a full overhaul of the aging system. The City Council announced Tuesday that its Transportation Committee will hold an oversight hearing to “closely examine where the MTA has fallen short.”


Kelly Kopp, 48, said he heard what sounded like a “huge explosion” before the A train came to an abrupt stop.

“It was enough to scare the heck out of us and for me to think I could die in this train,” said Kopp, a photographer who was on his way downtown.

“As soon as the train stopped, people started screaming. And that was really terrifying because I thought some fire was going to start shooting through the train. And then people were throwing up, too, from the smoke.”

Gov. Cuomo introduced a bill last week that would give him control of the MTA board to address ongoing issues with the subway system. But neither Cuomo nor Mayor de Blasio showed up at the accident site.

Newly minted MTA Chairman Joe Lhota held a hastily convened news conference and said in a statement late Tuesday that “the cause appears to be human error, not a track defect.”

The preliminary investigation found that the morning mayhem was caused by “an improperly secured piece of replacement rail that was stored on the tracks,” according to Lhota and interim MTA executive director Ronnie Hakim.

Work on the track had taken place over night and the old rail and unused pieces of the replacement rail were secured correctly in the center of the track, according to TWU Local 100 President John Samuelsen, who was briefed on the derailment by union officials.

Lhota, on just his fifth day on the job, added that the smoke condition was caused by debris on the tracks that went up in flames.

Seventeen riders were treated at hospitals for smoke inhalation and other minor ailments. The other half were treated at the scene, Fire Commissioner Daniel Nigro said.

Among those hospitalized was a baby boy named Yousef, who was covered in sweat and clad only in a diaper.

“There was a mother in distress. Her baby was hot and crying,” said FDNY Emergency Medical Technician Tuanika Brown who reached them at the 135th St. station.

Brown and her colleagues gave oxygen to the baby and his asthmatic mother before they were taken to Harlem Hospital for evaluation.

“The baby and her are doing fine,” Brown said.

Following the derailment, three other trains were stuck in tunnels between 110th St. and 135th St., trapping roughly 1,300 people. About 500 scrambled onto the pitch-black tracks, prompting a massive response from first responders, Nigro said.

About 200 firefighters and 100 cops rushed underground to shepherd them to safety. It took more than an hour for all of the riders to make it above ground, officials said.

“It’s a very dangerous thing to be on the tracks,” Nigro said.

Motorman Christopher Miller, 44, was being interviewed Tuesday by safety inspectors and underwent a drug and alcohol screening, according to officials.

The incident crippled the subway system during the morning rush hour — knocking out service on the B and C lines and large swaths of the A and D lines.

Service was fully restored on the C line by 5 p.m., but the A, B and D lines were all operating on a limited basis.

The MTA said the derailment caused signal, switch and track damage — and employees would be working through the night in a bid to restore normal service for the morning rush.

The out-of-control train left a trail of bent and twisted track parts, according to photos obtained by the Daily News. “It took down pieces of wall,” the TWU’s Navarro said.

Passenger Kirk James, 42, said the derailed A train came to a jarring halt while it was pulling into the 125th St. station.

Then the smell of smoke wafted into the car.

“People started panicking . . . we can’t open the doors. No one knows what to do,” said James, an NYU professor.

James eventually made it to the platform by walking to the front of the train. Along the way, he saw dazed riders on the tracks being aided by firefighters. “People are crying, people are grateful to be alive, but no one knows what just happened,” James said.

“She’s claiming that she was raped, that it was not consensual and that she said no over and over again,” Joseph Mure, the woman’s lawyer, told the Daily News.

“She’s not doing very well. She’s having a very difficult time. Obviously she is upset about everything that transpired.”

The woman’s boyfriend, Christopher Membreno, showed up with a posse at the Park Slope apartment building where the tryst took place early June 19 — after the woman called him and said she’d been raped, police said.

Video shows teens pummeling woman at Long Island high school graduation – New York Daily News


A group of teens viciously beat a young woman at a Long Island High School graduation Sunday, according to witnesses and a shocking video posted on social media.

Cellphone video of the horrifying attack was taken at the graduation for the 2017 class of William Floyd High School in Brookhaven, L.I. by a student.

In the video, at least three people were seen repeatedly punching and kicking a young woman while she was prone on the ground, covering her face.

At one point, another young woman ran up and punched her.

When the young woman finally got up, blood was streaming from her face, and her clothing was torn and ruined, the video revealed.

The young woman tried to get to the safety of an SUV as her attackers continued to come after her. Schools security personnel converged and broke up the brawl.

In a statement, school officials condemned the incident and said they would press charges.

“We are disappointed by the actions of those who instigated the incident on what was a joyous occasion for our students and their families,” the statement said.

“As a school and community, we won’t let the small number of spectators involved in inappropriate behavior overshadow the accomplishments of so many wonderful students and their families celebrating graduation day.”

Suffolk County police were investigating the incident. No arrests have been made.

The University of Delaware is cutting ties with a part-time professor who provoked a controversial firestorm for saying North Korea detainee Otto Warmbier “deserved” to die.

The Newark school said it will not re-hire Katherine Dettwyler, the adjunct faculty member who blasted the 22-year-old student as “young, white, rich, clueless” in a since-deleted Facebook post Tuesday.

Dettwyler last taught at Delaware’s Department of Anthropology during the spring semester, according to a statement Sunday.

“On June 23, the University issued a statement about comments that Dettwyler recently posted online, at a time when she was not employed by the University, concerning student behavior and the Otto Warmbier incident. Those comments in no way reflect the values or position of the University of Delaware,” the statement read.

Former University of Virginia student Warmbier was accused of pilfering a propaganda sign from a Pyongyang hotel and was sentenced to 15-years of hard labor. Seventeen months later, he returned to U.S. soil and died after spending most of his imprisonment in a comatose state.

Dettwyler came under fire for ridiculing Warmbier in the wake of his death at a Cincinnati hospital.

“Is it wrong of me to think that Otto Warmbier got exactly what he deserved,” read Dettwyler’s deleted post, according to the News Journal.

Six people hurt in UK after car runs into pedestrians near celebration for Muslim holiday Eid al-Fitr – New York Daily News


LONDON — Six people, including three children, were injured Sunday after a car ran into pedestrians outside a Newcastle sports center where people gathered to celebrate the Muslim holiday of Eid al-Fitr. Police said the incident was not believed to be terror-related.

Northumbria Police said they arrested a 42-year-old woman, who remained in police custody. The force said it was not looking for other suspects. They say a full investigation was underway to determine what happened outside Westgate Sports Center in the northern English city of Newcastle on Sunday morning.

“There is nothing to suggest that this is terror-related,” police said.

The ambulance service said three children and three adults were being treated at a local hospital for injuries sustained in the crash.

Video on social media, apparently taken minutes after the crash, showed dozens of people in Muslim dress, including children, screaming and rushing forward to see what happened.

He raced to his lover’s defense, killing a man he thought raped his girlfriend in a three-way tryst — and now he sits in jail fearing she set him up.

A disheveled Christopher Membreno was stunned on Saturday to learn that police believe the ménage à trois in Brooklyn involving his girlfriend and two men was consensual.

“I threw my life away for a f—ing lie? My life is over because of a f—ing lie?” a weeping Membreno asked a Daily News reporter in an exclusive jailhouse interview.

The 24-year-old said he barely remembers what happened early Monday after his girlfriend called him claiming she had been raped in Park Slope.

She sounded “distraught, scared,” he said.

Membreno rounded up some friends and they went looking for 20-year-old Manos Ikonomidis.

They found him leaving the apartment where the girlfriend had the steamy threesome.

“I just wanted some f—ing justice,” Membreno said at Rikers Island. “I wanted to hold him until the police got there.”

But cops say Membreno and his posse set upon Ikonomidis with bats and knives, leaving him to die in a pool of blood in the hallway of the building before taking off.

Membreno claims he was high at the time and doesn’t remember many details of the murder.

“He was fighting me. I had to defend myself. I had to fight back,” he said.

Police say there is no evidence the victim was ever on the offensive.

Ikonomidis, with four stab wounds in his chest and back, managed to knock on the door of a nearby apartment before collapsing.

“They stabbed me! They stabbed me twice! They stabbed me!” he told the stranger who answered the door. “I’m so sorry.”

Detectives believe that Membreno’s girlfriend, Ikonomidis and 21-year-old Jack Doherty were involved in a consensual threesome inside Doherty’s Park Slope pad before the killing.

The rendezvous ended abruptly, but only because the woman became upset when Ikonomidis started filming the sexcapades, cops said.

Soon after, Ikonomidis’ girlfriend — who was not involved in the sex play — received an ominous Instagram message reading “your boyfriend f—-d up and will be taken care of,” sources said.

NYPD Chief of Detectives Robert Boyce said last week that detectives were still trying to piece together exactly what happened during the doomed fling in Doherty’s apartment.

“We have a competing narrative in this case,” Boyce said. “We’re still trying to decipher exactly what happened that day.”

That was news to Membreno.

“Did she set me up? I deserve to know the truth,” he told The News.

Membreno said he hasn’t spoken to his girlfriend since being locked up — adding that he hasn’t slept or showered in five days.

“This is my life now,” he said, ripping open his beige jail jumpsuit and grabbing it in his fist. “I can’t do it anymore. I really don’t know what I have to live for.”

One of Membreno’s bat-wielding buddies, Gabriel Dos Santos, 24, is also jailed at Rikers. He’s charged with murder, weapons possession, gang assault and burglary, cops said Saturday. Cops are still searching for a third man they believe took part in the fatal mayhem.

Membreno, facing murder and criminal possession of a weapon charges, said he harbors no ill will against his girlfriend.

“I still love her even though she set me up,” he said. “I don’t know why I still love her.

“I just want some answers,” he added.

Detectives have not determined whether or not Membreno’s flame will face any charges.

“She has not been charged at this point with anything,” a high-ranking police source said, who noted that charges may never come. “Lying to your boyfriend is not the same as, say, lying to the police.”

A memorial service will be held for Ikonomidis on Monday at Dahill Funeral Home in Bensonhurst. He will be buried following a funeral Mass scheduled for Wednesday at Saint Nicholas Church.

Father of missing 5-year-old California boy Aramazd Andressian Jr. arrested again on suspicion of murder – New York Daily News


The father of a 5-year-old California boy missing since April has been arrested again, this time on suspicion of murdering his son.

Aramazd Andressian Sr. was taken into custody Friday in Las Vegas. He’s being held on a $10 million bail, ABC reports

The Los Angeles sheriff’s office is said to have worked with authorities in Vegas to make the arrest after investigators provided LA County prosecutors with evidence.

What evidence authorities have against the 35-year-old father has not been revealed, but it was enough that prosecutors could order Andressian be taken into custody. It’s also not clear why the California native was in Nevada at the time of his arrest.

Andressian was initially arrested in mid-April on charges of child endangerment and child abduction after he was found unconscious in South Pasadena’s Arroyo Park with his son, Aramazd Andressian Jr., nowhere to be found.

The boy’s father spent only a few days in jail. He was released after investigators decided not to move forward with charges. 

Authorities have spent the past few months searching for Aramazd. The toddler was last seen April 20 at Disneyland in Anaheim with his father.

A few days before the outing, Aramazd spoke with his mother, Ana Estevez, via a Skype video chat. Police were alerted that the toddler was missing when his mom called to report that her estranged husband had failed to drop their son off at a pre-arranged meeting place.

In addition to trying to locate Aramazd, police are still trying to determine why the boy’s father was passed out in the park. Investigators previously noted that there was no evidence that Andressian had been attacked. They also said his statements on what happened to his son were “convoluted and contradictory.” 

Aramazd’s mother has released a statement pleading for his safe return. 

“To my son, this message is for you my love: be brave, honey. I am counting the days until I see you honey and I will never stop looking for you,” she said.

The Minnesota branch of the American Civil Liberties Union released dashcam video showing what they’ve dubbed a “disturbing and completely unnecessary” exchange between an officer and a motorist suspected of resisting arrest and sparking a dangerous road-rage situation.

The clip starts off with Agent Joe Joswiak, a member of the Buffalo Ridge Drug Task Force, and another Worthington police officer pulling over Anthony Promvongsa in July 2016.

Joswiak hastily approaches the SUV, shouting profanities while demanding Promvongsa exit the car. As soon as the car door opens, the officer hurls his knee three times into the motorist, still wearing his seatbelt, before uncorking a flurry of punches and elbows.

The dashcam clip, filmed from behind in a second squad car on the scene, does not appear to show Promvongsa resisting. He was taken to a hospital where he was released the same day.

“Agent Joswiak’s use of force against Anthony Promvongsa is disturbing and completely unnecessary. We are calling for an investigation of Joswiak’s behavior for him to be held accountable for his brutal attack … up to and including criminal prosecution,” Minnesota ACLU Executive Director Teresa Nelson said in a statement.

Joswiak has yet to be disciplined, according to Nelson.

“I did not even have the opportunity to take my seatbelt off before I was literally blindsided by this unnecessary attack,” he said in a statement. “I immediately pulled over for the Worthington squad car and before I knew what was happening I was beat and ripped from my vehicle.”

“The video, viewed in a vacuum, shows only a short segment of the incident that is the basis for criminal charges,” the pair said.

According to a criminal complaint, Promvongsa tailgated and drove at the car of off-duty police officer Mark Riley, who said he felt the suspect “was attempting to harm him,” NBC reported.

Law enforcement said the exchange needed to be put into context, but would not comment further.

He then allegedly drove between two off-duty officers’ cars and told them “he was going to go get his boys and come back to get them” before speeding off, according to the criminal complaint.

Officers charged Promvongsa with two counts of assault with a dangerous weapon, fleeing an officer, possession of marijuana and driving with a revoked license. He’s pleaded not guilty, but faces nearly 20 years in prison if convicted.

Still, the ACLU has rejected whatever Promvongsa did ahead of the arrest as justification for the officer’s actions.

“Let’s make this very clear,” the ACLU said in a statement. “No matter what happened before the dashcam video began rolling, Anthony did not deserve to be abused by police that way.”

Trump Aides Respond to His Latest Conspiracy Tweets: ‘FML.’

As in, ‘f*ck my life.’

After a cascading series of controversies created in large part by Donald Trump’s Twitter account, the president took to his preferred medium again on Thursday to float another conspiracy theory: the Oval Office itself could be under surveillance.

Trump ended speculation on Thursday about whether he had installed a recording device in the Oval Office and made “tapes” of his conversations with former FBI director James Comey, a possibility he first raised in another tweet in early May. “I did not make, and do not have, any such recordings,” he wrote.

But then, unprompted, he floated another possibility: U.S. intelligence or law enforcement officials might have his office bugged. “With all of the recently reported electronic surveillance, intercepts, unmasking and illegal leaking of information, I have no idea whether there are ‘tapes’ or recordings of my conversations with James Comey,” Trump wrote.

It was a bizarre suggestion that took some in the White House off guard. “No clue what the thinking was,” a White House staffer said of the tweets. “He could’ve just said there are no tapes. It’s baffling, frankly.”

Instead of putting the “tape” issue to rest and leave it at that, Trump’s statements threaten to embroil the White House in yet another round of politically inconvenient questioning about issues—Comey’s firing, the FBI’s probe into Russian election-meddling, and Trump’s reported efforts to hobble it—that the White House has tried, with little success, to move past.

Informed of the president’s denial that he had recorded his conversations with Comey, a senior administration official replied, “At least that’s behind us.” When alerted to his apparent suspicions of Oval Office surveillance, the official replied in a text message, “fml.”

4-month-old baby found unconscious in Bronx home dies at hospital – New York Daily News


A 4-month-old baby found unable to breathe on a couch by his mother died in the Bronx early Thursday morning, police said.

The mother of Urijah Murray called 911 after she found her baby not breathing and unconscious in her apartment on Clay Ave. near E. 166 St. in Morrisania around 12:10 a.m., cops said.

First responders rushed Murray to Lincoln Hospital where he died, according to officials.

There were no obvious signs of trauma and investigators do not suspect criminality, police said.

Murray had four siblings, sources said.

The city medical examiner is investigating how Murray died.
